P45 Question?

    The last time I worked was nearly three years ago, my P45 is currently with an agency, who I have not worked with and it was left in over a year ago. I am hoping to register with a new agency tomorrow and they will ask me for my P45. My partner says it is usless as it is for an old tax year so I'm wondering what I do about it. Do I get a job and the next place talks to the tax office or do I ask the tax office about a new P45? If anyone has any feeback, I'd be very grateful to hear. Thank you.

    P45 is issued at the end of one job to detail the amount of tax that you've paid so far in the current tax year. This is so your new employer can correctly calculate your tax liability when you start working.

    Since taxable pay and reliefs don't carry year-to-year, a P45 from a previous year is irrelevant for the current year.

    Your new employer will ring the tax office and have themselves "declared" as your current employer. Many employers "wait" until they receive a P45 and may tax you incorrectly, so make sure they're aware that they will not be getting a P45 for you.

    So, should I get work through the new agency, they will be my new employer so they will need to call the tax office and sort it out, I don't need to do anything, just to explain to the agency that my P45 is irrelevant.

    Correct, but if you've been claiming social welfare, there may be some form they give you when you sign off, as technically they're your former employer. So if that's the case it would be worth speaking to them to find out.

    Very few employers will be ringing Revenue. Most will send in paperwork, based on the p45 that you give them.

    But you don't have a p45. So download a p46 (from www.revenue.ie), fill it in and give it to the employer yourself, and they can send that.

    ALSO, fill in a 12a (also from the Revenue website), and send that to Revenue yourself. Be very, very clear that you've had no work and no benefits this year - this point is not so relevant at this time of year, but becomes crucial as the year passes.

    I take it that you are registering with the agency looking for work and have not had a job offer.

    If you have not worked or not received social welfare in the current tax year all you need to do is submit a form12 A and this is an application for Tax Credits -so you will not be on emergency tax.

    When you say you are registering does that mean becoming a temp and working for them or are they just interviewing you for jobs for their clients.

    If they are becoming your employer then you need to get them to give you the information to complete section c of the 12A form.

    You can do this directly to the revenue and do not need a p45 - if there is a reason you cant explain to an employer for a lack of p45 -you can say you were paid as self employed before and thats acceptable answer.

    No job offer, registering with agencies for temporary work for the moment. I find the simplest tax matters confusing but I'm ok now, thanks for the offer of help with the form, appreciate it.

    Yes this is right, what i used to actually do was phone the revenue myself and tell them the details of my new employer if its the first employer of the year im with after a time out of work, and they then sent the details to the new employer.
