Serving notice

    Hi there,

    Just wondering if you had a 3 month temporary contract and a months notice is the period in the contract will you have to serve this?

    Is there still more than a month left on the contract? I don't see why you wouldn't have to serve whatever is in your contract.

    Ya there is a bit more than a month left. Just wondering if I was only legally obliged to serve a certain amount as I have been there for so little time and it was temporary etc.

    A fella started in my place a few months back on an 11 month contract. After about 4-6 weeks he got another job offer which was likely to be a longer deal. There was no problem with him handin in a weeks notice at the time. I suppose it would be down to your boss, but could they do anything if you just left anyway

    Ya hope it doesn't come to that but if it does it does!! Would love to now the law around the issue!

    The law only states minimum notice periods. If your contract states a longer notice period, then that's what you're bound to.

    Ah right this is what was confusing me:

    6.—An employer shall, subject to the right of an employee to give counter-notice under section 10 of the Act of 1967 or to give notice of intention to claim redundancy payment in respect of lay-off or short-time under section 12 of that Act, be entitled to not less than one week's notice from an employee who has been in his continuous employment for thirteen weeks or more of that employee's intention to terminate his contract of employment.

    I'm guessing that's only if there's nothing set out in the contract?
