crash advice

    hello,

    I was a passenger in a crash yesterday, it was nothing serious my friend just turned a corner and managed to rear end someone, no one was hurt though thank god, other then his car that is.

    I woke up today and am having awful pains in my arm and back where the seat belt would have pushed my body back (I was in mid air for a sec from the impact so it was fairly strong).

    Now I know what your thinking "yeah right buddy, your only putting it on to get a claim" well, no your wrong. I am actually in allot of pain but nothing that is hindering me much.

    my father was crashed into about ten years ago and his back has been sore ever since so as you can imagine I am fairly worried about my back. I am going to see a doctor if the pain doesn't let up or it gets worse.

    The person my friend crashed into was complaining about his neck and back at the scene so he is defiantly going to claim and shoot my friends insurance up by allot next October. If I claim will it put his quote up even more? I don't want to claim but if the other party does and the doctor says that I am going to have problems then I think I will have to pay for physio and doctors fee's or medicine.

    The way I see it is if the other guy claims it's already on his record and he looses his no claims so why shouldn't I?

    What do you guys think? Please keep in mind I am not trying to scam my friend or the insurance company, I just want to make sure my body isn't damaged and if it is I will need compensation to help with doctors and treatment as I will not go the rest of my life with a sore back like my father.

    Also mods if this is in a bad place please move it.

    His insurance policy is there is to cover accident to injuried parties in his own car as well as other parties in other vehicles who have been injured due to his fault- and of course damage to other vehicles and his own depending on type of policy he has.

    I can't give you medical advice as i'm not qualified to do so but from my own experience its normal to feel a bit sore a day or two after an a small crash. If its an ongoing problem then I would seek medical attention, and keep all receipts in case you do decide to claim against your mates insurance.

    go to the doctor now just to get it documented that you are suffering pain after the crash, if it eases off in a few days then brilliant if it doesnt though then at least you have taken the correct first step to cover yourself.

    I was rear ended a few years ago and muscle pain for a few days is normal. Go to the doctor anyway to get it checked out.

    As above, dont worry about the insurance. As above im not a doctor so cant offer medical advice but after severe truama or impact to muscles there can be a boost in adrealine which is why you might not feel pain directly afterwards.fell off my bike and broke my elbow and was fine for a day afterwards, even cycled home,but couldnt move it the next day. Id get your back x rayed in the A and E at least.

    You have up to 2 years from the date of the accident to make a claim if you so wish.

    Make sure to inform his insurer and much more importantly to go and visit the doctor. It is normal to experience pain after a crash but be careful not to self diagnose. I rear ended someone and as the driver of my car I had a lot of pain through my arms and shoulders for a week after from the shock through the steering wheel but I've been fine since then. However the other party self diagnosed themselves as having whiplash. After a a protracted period AXA told her to sling her hook elsewhere as she had no medical evidence to back it up.

    Your friends insurance will be loaded regardless of the severity of the crash AFAIK, usually it doubles the premium the next time he goes to get insurance.

    This is unless he/she was doing something idiotic like drinking and driving which will impact the premium after his driving ban however it seems that this is just a simple rear ending and nothing more is involved.

    Another way you can help your friend is if everything is ok after a few months (maybe 12 just to be sure) is to ring the insurance company to close the claim as your friend will find it very difficult to get an insurance quote with an open claim on the policy (I know I did).

    Hope that helps, make sure to go to the doctor and contact his insurance company asap.

    if you are injured - dont worry about your friend....look after number 1.

    goto Doc, get assessed, if still suffering pains - doc will tell you what to do.

    (if you are out of pocket... you need to be re-imbursed for the money you are spending - contact a solicitor and file a claim)

    As for everyone else thank you so much for your advice. I will go to the doctor tommorow just to have it on paper that I am having pains.

    the last thing I want to do is claim and fall out with my mate but as you can understand if there is not many other options what can I do?

    Hopefully the pains will subside, I always thought whiplash was what people pretended to have and it never really happend but I guess not!

    So just to be clear, I should go to the doctor, then ring his insurance carrier? If I need to seek legal advice which I am sure I will need to in the case of a claim will any solicitor do? I have never had to talk to one before so I have no idea.

    Also when ti coems to his insurance quote, if the other party claims his insurance will rise anyway so if I claim it shouldnt make it rise any more? I would feel terrible if it did and he couldnt afford it. I would probably give him some of the settlement to help him out as he really is a good guy. Would this be legal?

    Whiplash is a neck injury AFAIK, go to your doctor and don't assume it is anything.

    Do't be so concerned about your mate and what he will think.

    If you have a genuine claim it wouldn't be an issue for him or his insurer. He will be paying a higher rate now anyway. Also what is the point in claiming if you are going to give him money back?

    Ahh fair enough I always assumed it was an injury from "whipping" your body around :P

    I dunno to be honest I would just feel really bad as I feel like I would be stealing from him, I'm sure you get what I mean? But then again if I am injured and need to pay for doctors and solicitors I cant afford them myself.. I just don't know what too do. I think I will have to just claim in the end if the doctor tells me too. He will just have to take the brunt and be more careful next time.

    Also I heard from another friend that a claim will only stick with him for 3 years and after that it's stricken from his insurance. how true is this?
