    Hi,

I previously worked with a French colleague. She spent one year in Ireland and was employed during this time. She went back to France within the past two years and has recently returned to Ireland.

My question is, is she entitled to any benefits in Ireland as an EU citizen. She is actively looking for employment.

to qualify for JB in ireland her PRSI requirements alone are that she must have 104 prsi contributions made here since she started work + 39 contributions or credits made in ireland in the year 2009, 13 of those being contributions. it doesnt seem that she would have those, so that would appear to be out. if she applies for JA (the dole) she would have to fulfill the habitual residence condition. i would tell you to look it up on the citizensinformation.ie but to save you time i would be almost certain that she will not fulfill the HRC. if she wants to try to transfer a SW payment from france she would have to go back to her local office in france.

If she has worked and paid Irish PRSI since returning to Ireland, and worked in France while she was back there, she can also transfer her french PRSI equivalent to Ireland to help her qualify for Jobseeker's Benefit here.
If she doesn't qualify, its Jobseeker's Allowance she needs to apply for, and as Mrs.Byrne stated it is unlikely she will meet the habitual residence condition.
