Can Anybody Tell Me Whether A Person Has To Go To Court If They Are Brought By Someone Else?

My Ex Has Threatened To Take Me To Court Over Our Daughter But The Thing Is He Brought Me Before Because Apparently I Was Stopping Him From Seeing Her When Infact He Wasnt The Slightest Bit Interested In Her Unless I Was Apart Of The Equation.
So As You Can Imagine There Was Endless Arguments And Abuse On His Behalf Before The Court Case He Assaulted Me Out On The Street In Front Of A Family Member And Our Child And Then Tried To Take Her.

I Pressed Charges But Because He Had No Previous Convictions On Record He Will Only Get A Formal Warning But If He Does Anything Again He Will Be Charged But Because The Guard Cant Get In Touch With Him As Of Yet He Hasnt Had The Warning And Everything He Does Now He Will Get Away With It And Ever Since,Everytime Hes Been Out(He Doesnt Live In My Area)He Has Physically And Verbally Abused Me Each And Everytime.

But Even After All This I Have Been Letting Him See His Daughter But He Keeps Messing About With Times And Days By Either Sleeping In Til 3 In The Afternoon Or Clearing Off To Another Country Days Before And Not Letting Me Know That He Wont Be Taking Her And When He Does Take Her He Doesnt Do Anything I Ask Him To Do Regarding The Child So After Another Heated Argument When He Came Out To Get Her I Decided To Not Let Him Take Her And Now Because Of This He Has Threatened To Take Me To Court And I Dont Think I Can Deal With This All Over Again So I Need Advice Badly Please

Sorry to hear about the situation your in...

I suggest you let the Guy take you to Court and tell the Judge exactly what you just told us...

The Judge will be very interested in his physical abuse towards you and won't let him next or near the child till he attends Anger management etc..

Failing that get your Father/Brother/Friend to have a talk and give him a few slaps for good measure..

The fact that he hasn't been cautioned yet does not mean he can do what he wants. Report every single assault to the gardai.

What Would Happen If I Didnt Go? The Last Time He Brought Me To Court My Solicitor Told The Judge All About The Assault But Because It Hadn't Been Sorted With The Guards We Were Unable To Get The Statements That Were Made Against Him But The Result By The Judge Was On The Fathers Request But On My Terms But He Didnt Agree With This And Kicked Off In The Court And Had To Be Detained.

He Constantly Calls To My House And Threatens Myself And My Family Who Try To Stand By Me But Im Not Entitled To Any Barring Order Or Anything Like That Because We Never Lived Together And Everytime Hes Abused Me I Have Reported It To The Guards But All They Can Seem To Do Is Take It All Down And Put It On File So His File Is Getting Bigger But Nothings Being Done About It He Keeps Coming Back.

And Unfortunately I Dont Have A Male Figure In My Life To Give Him A Few Slaps Although I Would Be Glad Of That

I Really Wish It Would End Its Just An Endless Battle
