can i claim back tax?

    hi..

    im just trying to find out if i can claim the tax back on insolvency money i was awarded...briefly this is my senario...

    i was awarded 16000 from a case i took which fell under the "transfer of undertakings" act....
    as the company was in recievership i had to claim this award through the insolvency company....i was awarded this in 2008 but did not know i had to recover it from an insolvenecy company...obviously i eventually did...

    so everything went through fine and last week i was told my cheque was on the way....
    but i got taxed by about €8200....so bummed about it....i was told i had to pay that amount as it was emergency tax.....
    so i am wondering if i can claim it back??
    personal details are as follows...

    currently unemployed, living with partner and 3 boys....
    im on illness benefit and he's on job sk...he signs partime!!
    im unemployed since march 2008 after being on maternity leave...then claimed through my stamp until feb2010 when i was ruled unfit for work by g.p. (pregnancy problems) im currently still on ilness benefit....

    if any body could help me on this one id be very grateful...

    if the answer to both questions are yes then i can't see why not

    what did you get in relation to the payment ie a P45 when you ceased work ?

    no basically what happened was....the company i worked for made everybody redundant...went into liquidation but reopened shop 2 weeks later trading with 2 letters different in there name and brought back all staff....as i was on maternity i shouldnt of been let go...and also should of been brought back to the "new company" but alas a week before i was due back (feb/march) i got my p45 in post!!!
    got very upset and contacted the lrc...submitted my case primarily seeking my job back...they decided this was not possible and awarded me 16000 compensation..havent been able to find work since or at least one that is not to physically demanding as my back is shigged...
    so ive been told by the insolvency company the tax was deducted as i dont have a current tax cert...i dont mind having to pay tax but over half of the award just seems crazy!!
    im so ignorant when it comes to tax issues and keep phoning wrong departments..just not sure as to what i should do...

    registered for ros paye anytime and see what your current suitation regarding income and taxes paid.

    from what i can make out you should be able to claim it back as you were taxed on the emergency basis

    yes i registered yesterday with them so have to wait for pin number to access it...do u think i will get a good bit of it back??

    to be honest queenie1981 i dont know as i dont know your previous earnings or tax paid in the year, which be a factor

    if you need any help i be more them happy to assist you

    my earnings would always of fell around the 17500 mark...always not far off the min wage.

    based on a salary of 17.5k plus 16k your should pay tax and prsi of approx. 5k in total for a year based on 2007 tax year and approx the same in 2008 for a single person.
