Boycott NCPS

    Hi,

Having seen both my partner and her mother become innocent victims of NCPS in the last 3 months (both actually clamped without reason) and having read countless reports on boards about NCPS and other private parking enforcement companies, I think it's about time we boycotted these private carparks. Who's with me?!

I got involved in my partner's incident and resorted to the common and understnadable response of telling NCPS that I'd rather pay to rent an angle grinder than pay their fine. They told me I would be liable for criminal damage etc etc. So after a very frustrating and unsuccessful "appeals" process, I have come to the conclusion that the only way we can tackle these greedy, unscrupulous, money-grabbing wasters is to boycott their carparks permanently. Seriously, something needs to be done and you can be damn sure that our current (or next) sham of a government ain't gonna do it.

So I'll keep it simple: Please please please please please don't use an NCPS (or other private) car park ever again until the shower of leeches are put out of business.

    Vote with your feet :D

    2. Road Traffic Act, 1933 167.—(1) Every person who, without the consent of the owner or the person in charge of a mechanically propelled vehicle and without other lawful authority or reasonable cause interferes or attempts to interfere in any way with the mechanism of such vehicle while it is stationary in a public place or gets on or into or attempts to get on or into such vehicle while it is so stationary shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding twenty pounds.

    3. Under Section 9 of the Criminal Justice (Public Order) Act 1994 anyone without legal authority or reasonable excuse, wilfully prevents or interrupts the free passage of any person or vehicle in any public place shall be guilty of an offence

    You paid the randsom, why?

Yes yes, I have seen all the legal jargon etc but given the state of the corrupt and unjust legal system in this beloved country of ours, there is no point in pursuing such a matter through the courts. Absolutely none.

I didn't pay the ransom, my partner did. She wanted to get out of the carpark quicker than I could get to the scene with an angle grinder. I will never ever pay those blackmailing, leeches a penny myself.

    On with the boycott...!!

I don't feel that the motors section is the place for this kind of thread, but I'll let it run for a bit

I do feel your pain though, I got clamped by them at Christmas a few years ago in what I thought was a free public car park (at a train station in Leixlip). The kids (including a few months old baby) were cold and tired and we had to wait for a bit. The (un-)clamper, an Eastern European lad in his 20s arrived and mumbled something like "sorry" when he saw our situation. He looked miserable. I felt more sorry for him than for my kids or myself tbh. What a cr@p job he had. I'm paying more attention to where I park now.

I've been clamped just once in my life (for returning ten minutes after my parking disc expired in a municipal car park). Cost me only €20 as my crime was perpetrated within their 20-minute reduced-fine period, but it cured me for life of careless parking in clamping zones.

Some clampers are very thick-skinned and ruthless though, and as a breed they invite this kind of entertaining retaliation.

I was clamped back in November by this shower due to the location I was parked in being available for a certain of period of time for mothers to collect their children from a nearby school. They have a disclaimer up outside the car park which is badly worded and technically doesn't mention anything under the grounds which I was clamped on. The fine was also harsh (80 euro) and this was in a college carpark, so that means they're catching out poor students who would barely have a fiver to scrape together.

How successful is the appeals process with these guys does anyone know?

Considering it's run by themselves not very likely. Would be interesting for someone to go the whole hog and challenge the legality of being clamped by these unlicensed operators in court.

It's funny someone working as a security guard in a shopping centre or someone fitting a house alarm must be licensed by the PSA yet these guys go around and immobilise your car and demand a ransom to remove the clamp yet there's no background or criminal checks required on them whatsover to operate.

The key is in the phrase "public place". This is why they can have the authority to clamp as, provided there is sufficient and adequate signage, you subject yourself to the possibility of clamping if you park in a private car park.

Don't get me wrong, I am no apologist for cowboy clampers.

I've been using NCPS car parks for years, and i've never been clamped. Why would I want to boycott them?

I've been driving for years but never been caught by the revenue generators. Why would I want to get rid of them?

Perhaps I wasn't clear enough in my original post. The reason you would want to boycott NCPS is because they fleece innocent members of the public UNNECESSARILY i.e. against their own rules!

I have absolutely no problem with them running the business they do, in fact I would hate to see any firm go out of business in this day and age. My gripe is with the fact that they do not follow their own rules. On both occasions which I have mentioned, they clamped the cars without good reason. Ticket times had not expired (although they entered incorrect times on their warning and clamping notices to allow them to clamp).
So I have no problem once they follow the rules that they purport to enforce. It's when they operate outside of this that I have a problem. I am led to believe that they work on a commission basis - not sure how true this is but perhaps it would explain some of their unscrupulous activities.

Lastly, I don't at all feel sorry for the guys who are employed to clamp and release. I have no problem with them in most cases, they are usually hard-working men trying to earn a living. It's their greedy employers who need to cop on to themselves or be forced out of business.

But no one has, and it's unlikely anyone will, because of the cost needed to bring it to court.

why trust a company that does not list its terms and condtions on its website? as i said they have no morals and they do clamp cars on land they are not entitled too. and besides you have never entered into a contract with this company in the first place so why default?
