    Hi,

I bought a used car from a main dealer, car described as good (1999 Honda), but the day after I bought it I noticed a fault with the gearbox that causes the car to judder and vibrate, I reported the problem the day I noticed it (this was the day after buying the car and it did not show up on the test drive), nothing has been done yet, what I my chances of pushing for a refund?

You are not entitled to an automatic refund until the dealer has had a chance to fix it.

This repair MUST be FOC as you are covered under a warranty under the legal sale of goods act.

If the dealer cannot fix it, then you are entitled to your money back.

BUT, ask for a refund, they may just give it to you as it is 12 years old as some gearbox repairs can be expensive so its not worth fixing

I looked on the web about the problem over the christmas holidays and it seems it is a known fault on these CVT gearboxes

Does the judder just occur at take off?

I'd dump it back with them (respectfully) and ask for my money back and see how they react.

You need to be a bit more persistant with the garage otherwise they will just leave it on the long finger in the hope that you don't follow up.

Go back to the garage and speak with the Service Manager, explain the issue and say you want the issue looked at as soon as they can, be firm with them but polite as rudeness or loosing the head in these situations tends to get you no co-operation at all. If you still get no joy then take to the next level and speak with the General Manager.

This may be a very common problem. Dirt or corrosion on the clutch flywheel, or even a slight buckle. It often happens in cars that have been off the road for a while.

It's easily solved. Engage the clutch while pressing the brake a few times. The car will cut out as the clutch engages. This often clears the surfaces.

I purchased a car last year that had been in a shed for a while. It juddered on take off, I did this about 10 times over a couple of days and the clutch has been perfect ever since.

I am getting frustrated now, the dealer has had the car for 3 weeks, and I am without wheels, what can I do in this situation?, I bought the car, driven less than 500 miles in it...

Have you contacted them to find out what they are doing and why is it taking so long?
