Redundancy payments waiting time

    Hi all, 1st time poster

    I was made redundant in october '10 after working with a contractor for four years. In discussion with the redundancy payments section, the earliest processing time for payments is 9months. I literally cannot afford to wait that long.

    Is there any way of accelerating the processing time for individuals? I understand that in recent times the amount of claims would have increased exponentially, hence the lengthy waiting time. I also understand if there was a widely known means of speeding up individual claims that everyone would be using it!

    I have sent letters and contacted the NERA locall line but neither has yielded positive results. Any help would be much appreciated!

    If you were made redundant and entitled to redundancy, you should have had the cheque in your hand on the last day from your employer, and they have to claim it back off government

    on the date of the termination of employment your employer must give you a "Redundancy Certificate" - section B of form RP50 - and should pay the redundancy lump sum due to you.

    If your employer has not paid your redundancy lump sum, you should apply to your employer for it using form RP77 (pdf). If your employer still refuses to pay it, you can apply to the Department of Enterprise, Trade and Innovation for direct payment from the Social Insurance Fund using form RP50 (pdf) as follows:

    If your employer is unable to pay your redundancy lump sum, he should sign the RP50 and submit a letter from an accountant or solicitor stating he is unable to pay and accepting liability for the 40% owing to the Social Insurance Fund together with documentary evidence such as audited accounts
    If your employer refuses to pay your redundancy lump sum or if there is a dispute about redundancy you can bring a claim to the Employment Appeals Tribunal using the application form TI-A. This must be done within one year of your dismissal. To apply for your lump sum you should send a completed form RP50 together with a favourable decision from the Employment Appeals Tribunal

    Thanks for the replies, this is statutory redundancy.

    A liquidator was appointed to the company and the RP50s were filled out and sent to the department through the receiver. Talking to the department, the claim has been received but processing has yet to begin. According to the department this could take up to 9months, which I cannot wait for.

    As i've said i've emailed, wrote and rang the department but to no avail. I'm not really in a position to wait the 9months so i guess i'll have to continue my campaign. Called into the department offices today, but you cannot even go up to the payments section to talk to anyone there!

    quick question??? how long does it take for an employer to receive that 60% from the goverment???

    from the one example I know of for sure it was nearly a year.......

    Sorry man, dont know much about the details. If I was you I would call the taxman direct, they are very helpfull from my experience.

    I'm in the same boat as you only I was made redundant in May 10. No sign of the redundancy yet.

    I have been through the Employment appeals tribunal with regard to my employer refusing my redundancy. Fortunately they found in my favour that was in November 2010.

    Got letter today from Dept. of Enterprise, Trade and Innovation asking me to sign and return bottom of letter if I have yet to receive payment from employer.

    My employer has ceased trading and the redundancy is coming from social insurance fund. Does this letter mean I can expect cheque from them soon or is this the start of a 9+ month wait?

    You aren't going to be able speed it up. I encountered a lot of these situations in my previous work and basically it's 9 months and that's it; DETI have the same amount of people working for in the Insolvency Payments Dept in 2011 as they had in 2007 as far as I know. Clearly there's been massive increase in insolvency payments in that time. You're going to have start putting together a Plan B because you will not get that money in a shorter time frame regardless of your circumstances.

    i signed a rp50 form yesterday..the boss gave me his 40% but asked me could i wait for him to be paid the 60% from the goverment to give it to me then and i agreed but i thought it was only up to 8 weeks waiting..

    Hey guys,

    The company I worked for went into liquidation in June last, signed off on all the paperwork with appointed liquidator almost 3 months ago now and have heard nothing.

    I am also due 8 weeks notice pay which they said would come thru faster than the lump sum... still nothing... should I be calling the liquidator or revenue to chase it up and see where its at?
