Hi all,
Vanilla are planning an update to the site on April 24th (next Wednesday). It is a major PHP8 update which is expected to boost performance across the site. The site will be down from 7pm and it is expected to take about an hour to complete. We appreciate your patience during the update.

insurance, how long do i wait

    need some advice and im not sure who to ask so here goes.
    i was crashed into in august of 2010, driver admitted liability at roadside and put them same down on paper that day.

    car was deemed a write off by his insurance companys assesor but still have not received a cheque for my car.

    there are minor injuries involved (was out of work for about a month) and there is a civil case as a result of this

    car was bought for 2500 in early feb so not exactly huge sums of money involved here.

    basically im trying to find out is there a time limit on settling a claim ie 6 mths from when submitted or can they just delay it indefinetly??

    Your own insurance company should be keeping you informed.

    That may be a problem. You never admit liability, it is a stipulation of all car insurance contracts. Who have you given this signed admittance of liability to?

    If the other driver's insurance company have access to that documentation they might have told him several months ago that he is on his own.

    Who are you claiming against? Is the other driver's insurance company covering his defence?

    If they are, the cheque will not be seen until after this case is heard.

    Indefinitely, it is called due process.

    Not worth the ink that it was written with!!! Insurance company will access who they think was liable and the other driver can say he/she was in shock and did not realise what they were doing when they wrote it.

    Wrong. If there is third party damage and a personal injuries claim the damage claim can still and should be settled well before any court case!

    Not correct. If you settle the damage claim, it has potential to prejudice the insurers defence for the injury aspect. One will not be admitted witout the other

    Completely wrong. Once an insurer has deemed they are liable for the claim they are obliged to settle the damage element asap. The court case for awarding any damages however is a separate matter. And the repair of the vehicle would not prejudice this.

    Where has it been stated that the insurer has admitted liability on behalf of their client? That is entirely my point. If they settle the property damage section of the claim, they are wide open on the personal injury claim. What the client admitted at the scene has no effect, whether they wrote anything down or not
