    Hi just though Id ask you all you guy's a legal question.
    My car has no nct and I was stopped at a checkpoint and told to get it.
    I brough the car to the test centre and they fail the car on the brakelines. So I got them cleaned and a corrosion proof barrier applied, then i brought the car for the retest and they said the repare was not good enough and the airbag light was on too!. so I went back to my bmw garage and they said the line s were fine and they could not understand what they were on about, then they told me the airbag light to repare was costing 500 euro. In all this time my 10 day to get the nct to garda station was waisting away, and subsiquently disappered ( by now it was 20 day) these thing do take time especially with getting time of work for all this, anyway I dont have the money to spend on the car as I am alway's forking out on the piece of crap, so I ve since grouded the car to the garage till things get better. I since got the summons to court so now I dont know what to tell the judge? will he undestand or will they be money hungry as always with there injustice system and give me a great big fine? thanks

    Tell the Judge the truth. The fact of the matter is that you were caught driving without NCT and unless for some reason the Judge is feeling amazingly generous I don't particularly see why they should let you off?

    Did you not realise that your car was due for NCT before it expired? Did you book it in for NCT before you were stopped?

    The Garda didn't have to give you a warning nor 10 days to produce. He/she could have cited you on the spot for having no NCT.

    It's not like the NCT guys are just picking on you. They have set standards which must be met. The airbag light could potentially be very serious, so no wonder they are insisting it's fixed. No airbags could be the difference between a minor or a major injury in a crash (never mind death).

    I can't see why a judge would take your side here. But you can let us know how you get on.

    (I supose the judge hears cock and bull stories every day, why should he beleive me.

    you are right paul, but the dispute I am having with the nct centre is that ,my entire seat has to torn open to replace this airbag pressure passenger sensor,( for the front seat passenger only the rest is fine) I have 2 other cars that have no air airbags at all and they flew through the test. I cant see the sence.

    I did tell them at the garda station when i brough up all my credentials, licence, insurance, tax, etc etc, but the gard on the front desk said its up to the gard that stopped me. it was even a differant garda station. I did bring the receipts from the nct to show I was in the mist of getting it.

    If the car has airbags, then by the NCT rules, those airbags must work correctly. If there were never any airbags, then they just ignore that section or tests.

    These guys are simply doing their job, and following the rules set by the Govt. It's not like they make up faults nor do they make any money from you having to fix it (other than the retest).

    I can't really see how a judge will rule for you on this.

    Your right to a certain extent, but how do you know so much abot the NCT?

    I know SFA about the NCT. I've never had to do it (newer car). A friend of a friend is a mechanic who works near an NCT centre and he gets a few fails who drop by.

    All cars four years and older must undergo an NCT.

    I work for the NCT :) Did you bring the car in for the NCT within the 10 days you where giving by the guards. If so ring 1890 200 670 which is NCT customer services tell them your in court, ask them will they do you up a letter to say the date your were in for the NCT and failed, the will prove you did try get it sorted and get a letter from your garage stating how much it will cost to repair on headed on paper, i'm not sure if that will get the judge to strike it out or not. If your car is manufactured will an air bag it has to be working, they can't test the actual air bag, if the light stays on all the time it will fail and if it dosen't come on when you put the keys in the ignition if will also fail :D
