An order to pay??

    hey boardies was hoping you could help please feel free to move this post if it in the wrong catorgy

    i have an ongoing claim after a car crash for the past 2 years ive been through PIAB etc and have been made an offer im going to accept it (have my form sent off) and seen as the insurance havent got back within the 21days (was 6weeks ago at this stage) weather they have accepted or regretted it an order to pay has been issued

    Does anyone know how long they have to pay up after this has been issued
    Or if there is a time frame my solister isnt back until monday week

    When you say you've been made an offer- you mean the PIAB ruled and issued their recommendation? They have 90 days, and not 21 as far as I know to respond to each stage of PIAB, including this one. If the insurance company do not respond at all, they will be deemed to have accepted the offer but the only one who can make them pay is a court. If it comes to that the PIAB will issue you a document allowing you to pursue them. In all likelihood they will agree to PIAB though.

    I vaguely remember getting someone to look at this for me before and the conclusion was that there was no fixed period of time in law within which an Order to Pay must be paid. Therefore, it comes down to what is reasonable etc.....

    Warning though, it was a while ago and i dont do much PIAB work - someone who does that work regularly should know the answer pretty quickly.
