If my name was spelled wrong on a summons, can I get it thrown out? or is there anything else I can do?

Under the District Court Rules the judge is allowed to make amendments if there is no substantial alteration to the summons, I think a minor misspelling would probably fall into that category.

I don't know the exact wording of the provision so if anyone can help it would be useful but I wouldn't pin any hopes on getting the case thrown out just because Michael was spelt as Micheal or something similar.

We definitely need a F.A.Q. sticky I think.

Nah - 'twould be legal advice.

And in any event there is no legislating for what the local District Court Judge will make of a given situation, notwithstanding what 'should' be the position.

No we need people to read the charter or face a problem.
