site name change over

    My dad has a site and i want to get it changed over to my name as i wish to apply for planning. What do i have to do. How do i go about this. Thanks

    You dont actually need to own the land to apply for planning permission on it, which is important to note with capital gains and other taxes.

    You'll need to talk to a solicitor about transferring the land, and more than likely get a OSI map marked up with the bounds of the site by an architect.

    As stated above you dont need to own the site in order to apply for planning permission. In fact, dont even consider getting it transferred into your name until you have PP. At planning application stage you will simply need to submit a letter signed by your father indicating that he has given you consent to make the application on his land.

    Get a local architectural technician to look after the planning stuff for you and the same person will do the mapping work then for the transfer of the site. After (hopefully) you get your planning permission you should then contact your solicitor to arrange the transfer of the site.

    The new budget has significant implications for the transfer of sites. Existing reliefs have been abolished. I managed to get mine transferred a few days before the budget. Your folks may be liable for CGT. Talk to your solicitor and he will give you more info but as mentioned already, dont transfer the site until you have PP.

    Does the Stamp Duties Consolidation Act 1999 (83A) still not apply mainly if the site area to be transferred is under the 1.0 acre?

    If not, what are the new implications for usual site transfers?

    Mods, this is relevant to this forum and not the finance section....;) We will all have to know this..:)

    This is my understanding of it;

    Stamp duty reliefs: Transfer of site to child – the stamp duty relief on the transfer to a child of a site of up to one acre has been terminated, with effect from 8 December 2010. However, the capital gains tax relief has remained in place.
