Notebook bought on ebay not working and return date expired. Have I any rights?

Hi everyone, I'd really appreciate some advice on this issue. I bought my sister a notebook from ebay for Christmas. I found a mint condition (gift only used once or twice) Acer Aspire online for a very good price in August and I thought to myself, sure why not? When it was delivered, I took it out of the box, plugged it in and everything seemed fine. Put it away and four months later, presented it as a gift. Now I feel pretty devastated. The battery doesn't hold any charge and the battery icon is constantly flashing orange, despite 8 hours of charging.
Have I any grounds to make a complaint to the seller? I know my returns window of opportunity has passed but as a buyer of a laptop, am I entitled to any sort of guarantee? The laptop hasn't been used since it was bought and if I had bought this in a shop, I would have been entitled to return it. But I suppose that's what I get for my attempts at recession thriftiness :(
I would really appreciate some advice. Thanks!

unfortunately since its more than 45 days since the transaction date, you cant file a dispute with ebay/paypal.

Perhaps you could try a credit card chargeback (although I dont know if you can do this for "not as described" items)

Thanks Max Power1, I appreciate the reply. I called Ebay customer services and they suggested I apply for a credit card chargeback as the item was not as described- mint condition. Hopefully I'll come to a resolution with the seller though.

I don't know about this but you could try go online and fill in the warranty form(if the previous owner hasn't already) then contact acer and try get them to sort it out. Look on the bright side a new battery/power supply(could be either) doesn't cost much. So maybe you still got a good deal.

    Happy christmas.

try this - it is taken from another forum :

Just a little more information on the Acer Aspire One Battery not charging issue:

BIOS revision 3309 (and later) has a fix for battery charging particularly the 6-cell batteries, however if you have the latest BIOS and your battery still isn't charging a good solution is to power down the computer, remove the battery and unplug the AC power cable then push and hold the power button for a whole 2 minutes (nothing will happen, we're trying to completely drain all residual voltage from the mainboard to reset it), then release the power button, install the battery and power up the computer, it should now recognize the battery and begin a normal charge cycle.

I have read other posts that claim to hold the power button in for 1 minute which I tried and it did not work, you must hold it in for the whole 2 minutes.

Cheers for all the advice. Will give all of the above a go and see how it goes. Would be great if I could get it working or get a warranty. Don't want the hassle of refunds but don't want a dodgy product either.
