Snow days..told to go home....Pay?

    Every day it snows we either get sent home on a half day or told not to come in at all as we work in a shop that gets nearly all of its business from schools and when they are closed it's dead.

    Are we entitled to any of those lost wages? Heard of other retail staff getting paid if they are sent home!?

    This hasn't happened to me, and I work in a supermarket. Generally speaking it will depend on your contract. If you are on a flexi contract generally your terms dictate a minimum of 15 hours per week. So legally speaking they don't need to pay you anything above that if you only work 15 hours in a week.

    If its dead in the shop on those days - where do you expect them to get money from to pay you wages - its not the business's fault that no money is coming in - they are clearly trying to keep the costs down. So therefore you would not be entitled to any wages for not working. You could ask them to put through holiday pay that has accumulated to date but that is all.

    Is this always the case? e.g. I am paid a salary and have my 20 holidays a year, if I had taken all these but the business shut before christmas during the snow do I not get paid?

    AFAIK Employers must give a months notice of holidays they are forcing you to take, like christmas or good friday etc. This should be no different, my employer could not just say I have to take next week off since there was a spot of rain.

    There was a guy on TV3 interviewed saying how employees have no real rights as nothing is in legislation, this was concerning employees not turning up for work because of snow -they said it was not an excuse and was at the discretion of the employer but technically you were not showing up for work. This seems like it should be the same in reverse, i.e. at the discretion of the employee if he accepts what is in effect a forced holiday with no notice.

    I don't have a clue about part time or flexi contracts etc- just thinking of my own situation with salary.
