    I am looking for some opinions on a legal related issue. It relates to a will.

    If someone is left an amount of money in a will, with the deceased leaving their home & control of their estate to another person - This other person has said that the amount of money in question is no longer available given that it was spend prior to the deceased passing away - Is the executor of the will liable to pay this sum as outlined in the will, given they are in contact of the deceased estate?

    Would this apply is the home was sold? Or would it apply anyhow?

    Any opinions would be appreciated

    If its true that the money was gone before the deceased passed away then you are entitled to nothing.
    If the deceased had owned two property's and left you one of them. But then sold it before she died, the grantee of the other property would hardly be responsible for buying you a new property would they?
