Lost my job...

    I know I'm not the first one, but I have just found out that I have lost my job. There won't be any work for me in January.

    I'm a Graphic/Web Designer. I was taken on initially to cover maternity leave and signed a six month contract. I was then away on honeymoon and when I returned my contract had expired. I was told that I was being retained on a month to month basis. I never signed anything to say this. I just worked away, hoping I would be made permanent. I have been told I'm not needed in January, which is a few days away, so basically it isn't a months notice...

    My question is, if I was employed only on a month to month basis, am I still entitled to a months notice? Thanks

    I was in a similar position to you except I handed in my notice to them. I was due to finish on the 31st and gave them notice on the 13th December to finish at the end of the month. I was on a fixed term 6 months contract which was extended by one more month so see how it would go. It didn't go...............:(

    Either way they have to pay me till the end of the month but then again my contract expired then so legally they had to.

    Whether or not you have a legal right to be paid is one thing.

    Are you paid weekly, bi weekly or monthly? This can depend on how it could go for you.

    Most employers would be willing to finish the month by paying you for it but wont likely pay you further than that.

    I mean, what would you do if you were the employer? You'd realise it was Christmas and have some compassion, pay the guy till the end of the month and shake hands.

    Without anything in writing thats what you best hope for. There is nothing much you can do other than being upfront and asking your boss.

    On your notice, without anything in writing again its the same. You are entitled to nothing since your actual contract expired but seeing as you are calling it a "month by month" then you should expect it to last till the 31st December.

    Sorry to heat that mate. I lost mine two years ago so at least you won't be waiting as long as I have to get another job.

    Only one weeks notice is required if you have been employed for over thirteen weeks and less than two years.
