    Hi there,

    If someone has a new business and due to ignorance didnt get planning permission for the change of use of the property would they be in big trouble?

    If they got a letter from the council saying that it was being investigated Could they apply for planning permission then?

    Any advice is much appreciated!!

    she may be able to apply for planning retention. she should sopeak to a solicitor and the council and ask them if she can apply for retention

    It might be best to get someone with a town planning, architecture or engineer qualification to apply.

    Now every change of use needs permission, but best be on the safe side by getting proper advice.

    If your premises is causing a nuisance, you may be subject to court action.

    wouldn't consider this a legal issue really, there is a construction and planning forum.

    i wouldn't wait for a letter from the council though. if they do find out, and it just takes one neighbour to call about it, they'd be pretty peeved if it was done behind their backs too.

    there are some rules about change of use to commercial, such as distance from a town centre, parking, rates etc. but every case is taken on it's merits.
    do it the proper way.

    its an industrial unit in an industrial estate, so she didnt realise she had to change the use as its still for commercial use.

    Is there a noise level thats allowed in an industrial unit?

    Could one of the mods please move this to the construction and planning forum?

    that's totally different then. i thought it was from residential to commercial. she still needs to inform the council about it as she'll have to pay commercial rates. better to do it now than to get a hefty bill in a while. i doubt there'd be too much of an issue, but i'm basing that on working for a local authority for a few summers while i was in college.

    thanks for that, im less scared now (Hypothetically ;) )

    I've already started paying rates about three weeks ago, would this have triggered the planning department to contact me, or would it have been that someone complained me (hypothetically)
