Insurance brokers obligations

    Hi,

    I find myself in the rather unfortunate spot of finding it very difficult to get motor insurance. The details are as follows:

    November 2008 I recieved a disqualification. I was a named driver on another policy at the time and we informed our insurance broker of the disqualification. He was a trusted broker for all our family's policies.
    In May of this year I asked the broker to get a letter from the insurers stating that they would insure me so that I could get the disqualification reduced... which he did.
    In December this year (after the disqualification was over) I went to a local brokerage and obtained a very good quote for insurance in my own name (€800). I paid for the policy. The insurers came back requesting additional information, i.e. a letter from the previous insurers stating that I had informed them of the disqualification. I again contacted the old broker and he forwarded me a letter stating that the insurance had been informed in May 2010. The new company then declined the insurance on the grounds that I did not disclose at the time of my conviction. I am now faced with a €2500 bill for insurance because of this. I talked to the local brokers and they stated that the previous broker should have informed the insurance company at the time we had informed him. His reasoning for not doing so was apparently to protect the main policy holder and stated that there was only a couple of months left on the policy anyway and he felt we could inform them when I was looking for a quote.

    My question is does the original broker have a case to answer here? Was he legally obliged to pass on the information? Can I recover the difference in the policy fees from him based on the fact that he did not do what he was supposed to do when he was informed? What is my best course of action.
