Accident claim from Other Party's car insurance company

    Hello,

    Few days ago, someone car banged mine from behind at traffic signal (thank god everyone was safe), which damaged my car bumper, car boot & boot door badly. Nothing happened to Other Party's car. I called the guards at the scene to notify & Other Party accepted the fault in front of the guards. We also exchanged our Insurance details etc.

    A local garage estimated me € 1600 for repair with new parts. Other Party contacted their insurance to claim for my car's damage. Next, Other Party insurance company asked me explain what happened & who's fault was it etc stuff, that i explained. However when I asked to know about the claims process, they never explained me :(

    Then they sent out Car Auditor to analyse the damage & he agreed on the cost involved like garage said. Because my car is over quite old (1999 model), he told that for fixture cost of €1700 on this car, their insurance company would probably sign-off my car. He alternatively suggested - if I go for repair with Used parts under €900, then insurance may agree to repair my car. On asking the process, he asked me to wait for someone from Other Party's insurance to contact me in coming days, being next step.

    Roughly market price of my car is ~1400, but there's no similar good specs available (mine NCTed very recently, very low on mileage). I would prefer to keep the car because I wouldn't get another one of similar specs for similiar price.

    My questions:
    * If Other Party's Insurance company offer for fixure with used parts. Should I accept it (however i may not be sure about the durability for used parts)?
    * What I am entitled to, if I refuse Used parts & they want to sign-off my car?
    * What is the claims procedure usually? & how long usually it takes?
    * Any other possibilities/options that I should be aware of? Any suggestions pls.

    Yeah, with "OP" I mean "Other Party". I saw OP on other threads & assumed it to be a term, sorry for wrong assumption. :cool:

    iirc ... you can insist ont eh car being repaired back to original condition, as long as the damage is not structural.
    ring the insurnace company of the other party directly and tell them that you want cars repaired with new parts... they will try and pawn you off cause it cheaper for them to pay you €1400 less scrappage monies (money insurance company recieves froma breakers) than to pay €1700 in repairs... this is what they call a BER... beyond economical repair....

    but you can insist that they do repair it

    No, you can't.

    as i said "IIRC"
    as a third party as long vehicle is retuned to orginal state he can insist ( exceptions are structural damage like a Class A, Class B on the Uk salvage system)

    let them write your car off,(provided you get a decent price) Tell them you want to keep the car so they will pay you out less the salavage cost.

    When I was hit from behind the insurance company wrote off my car, I told them I'll keep the car so they paid out less the salavage cost.

    95 bmw 316 coupe
    85k miles
    LOADS of extras

    They paid €2100
    Salavage value €200

    I kept the car

    they came offerring
    1. repair with old parts, but they do not take any warrantee/durability of parts replaced .....risking drivers life to save their money
    2. sign off for €1100
    3. keep the car for €1100 minus Salvage cost. and asking to get NCT done again if taking this offer becoz price includes current NCT's value (I cant understand this...even if it got NCT passed weeks before accident)

    Which offer you suggest?

    My advice (having gone through the BER process before) is to get them to pay for the damage less the value of the car. The car isn't worth anything much IMO but be prepared for them to say its worth €500 or more. In other words get as much off them to recoup the cost of repairs as much as possible.
    Then, once you have the cheque cashed, you organise any repairs required whatever way you see fit.

    I'd go for option 3 if you can get the repairs done for that cost :)
