family maintenance

    Hello everyone.

    Was looking through the threads, found some useful information.

    My cousin just separated from her husband and is taking care of the child, as father has no intentions to see his son. Father does not support his son or her in any way and refuses to do so, Child benefit is coming to his account as she did not had one at the time, and even thou he gets 150 a month, he does even intend to share that money. So we have a serious situation here.

    She is applying to get one parent family payment and FIS as she is in full-time employment. (getting below 300 a week). As father refuses to pay any maintenance, we are thinking about District court, but she was put away after we got to know that court decides who should pay the maintenance after comparing means.

    Lets say he is unemployed while she is in full-time employment and is taking care of the child.
    Is there any chances she would end up paying the maintenance to him?

    If he is not involved with the child, at all, then why would she?
    Maintenance money is to insure the well being of the child.

    Contact the child benefit department and let them know...they should be paying the parent with the child.

    Have already sent a letter with some info to them, It's frustrating to get no answer, even thou sent it a week ago. will ring them tomorrow just to know if there are any updates.

    OP - if he is not taking care of the child then he is commiting fraud by keeping the child benefit payments. Report him to the revenue / welfare, and they won't be long cutting him off. He has no right to that money whatsoever.

    The bit in bold in what is relevant here, spousal maintenance is completely seperate from child maintenance and he can apply for spousal maintenance. Whether or no he gets it is up to the courts if he goes through the courts, or it can be done via an agreement between the two.

    But as an ex spouse he can apply through the district court for spousal maintenance.
