    quick question...is incitement (part of the incohate offences) catered for under legislation? or are they classified as common law offences?

    Incitement to commit an offence is contrary to common law.

    There are a couple of statutory incitement offences (e.g. incitement to join an unlawful organisation under s. 3 Criminal Law Act 1976, soliciting murder contrary to s. 4 Offences Against the Person Act 1861)

    Yeah it's a common law offence. The Law Reform Commission published its report on Inchoate Offences a couple of weeks ago and recommended that its made a statutory offence but for the moment it's common law.

    If you need more info on incitement the report is quite good and is on the LRC website
