    Situation 1 .What happens if your caught workin on the btea ? (back to education allowance)


    or situation 2. lest say for instance in another situation you werent claiming anything but you just werent goin through the books is the burden on the employer then ?

    situation 1 - liable to prosecution & repayment of benefits if not entitled to the benefits.

    situation 2 - I always thought that an employee could be in difficulty here but this was trashed out in another thread and it would seem the better view is that it is the employers problem, where PAYA/PRSI has not been deducted. If however an employee was in receipt of income not declared and claiming benefits they could be prosecuted for that and liable to repay the benefits but that's not the situation you describe.
