Neighbours company van hit my uninsured car.

    Before you get on your high horses complaining that I got what I deserved for not being insured read the story.

    Last week I picked up a uk registered BMW E30 318is, had it delivered and parked OFF the public road on private property. On tuesday my neighbour in his company van skidded off the road and took out the bumper, drivers wing, one headlight, maybe the inner wing and front panel, I'm not sure yet. My neighbour has admitted he caused the damage and is going to pay for the damage but... If things get nasty how do I claim against him? Obviously I can't contact my insurance company as the car is not insured so what do I do?

    sorry to hear that...

    as to being uninsured, that wont effect the claim, but you will have to have his insurance company pay for it all..
    if it gets nasty it could be a long protracted case...

    It's nothing to do with your insurance company, especially since you technically dont have one, given that the car is not insured.

    A third Party policy which is the minimum that a driver can have, covers losses incurred by a third party as a result of an accident for that driver is to blame.

    In the event that the van driver changes his mind, its HIS insurance company you need to contact.

    However, he has admitted liability and indicated a willingness to cover the costs. He seems decent enough so I would have thought you should be giving him a chance instead of posting in here.

    If your neighbour knocked down your wall with his van ,the insurance would have to pay out ,your car no difference.In saying try to do a deal for cash .just dont screw him.

    I don't see any trauma here, beyond the crash. Let him take the lead but don't let it lie too long. Equally if he asks you to get an estimate don't be tardy.

    He is decent, we were in the same class in school. I am giving him a chance, he's agreed pay for the parts and can pay me for them over time, I'll fit them and won't charge him for the labour. I'm not even going to fit new parts, I'll be scouring ebay and the e30 forums for 2nd panels in Lazur blue (not a common E30 colour) but it's still going to cost €250 to €350 as the parts will probably be from the uk or mainland europe and will have to be couriered and it's not going to be cheap due to the size of the bumper. I'd hate to think what new parts would cost.. But there's always the chance ( I honestly doubt it in this instance) that no matter how decent someone is that when the money involved is higher than they expect that they might change their mind. He also has 4 young kids and christmas is coming

    P.S. Pity it didn't happen last year, I had a Zinnober red E30 parked in exactly the same spot. If he'd hit that one I could have had it fixed for around €100 as the red is a far more common colour.

    Try mark allen in kildare for parts .pm me i will give you his number .he used to have e30s lying around bmw specialist.

    I think you're being pretty fair here OP, I tipped someone parking a couple of months ago, and a bumper respray cost €170!

    Keep the guy up to date with costs as you get them, that should make sure he is in the loop about the costs and be able to budget for them.
