Looks for your advice on this scenario.

I bought items on ebay from a seller in the UK.
Paid by PP and they arrived - but they rubbish, total rip off imitation tat .......so I cantacted the seller and aired by grievance. They said No, this is good stuff blah blah blah....
I said look, you sent me goods significantly not as described and marketed, so i'd like a refund. They are looking for me to return it to get a refund - it'll cost near €10 to post it back and they are looking for it to be recorded mail - it was'nt even sent recorded mail. The order value was only £13?!?! So, I said NO.

So, I put a claim on PP - goes like this -

    • 11/25/2010 - PayPal: Seller escalated this dispute to a Claim.
    • 11/25/2010 - Seller: I would like to refund the buyer if the item can be returned in its origianl condition, but the buyer refuse to do it.
    • 11/25/2010 - Buyer: the item I received is significantly not as described, utter rubbish.

Now, I've got a message from PP -

After careful review, we have determined that you are eligible for a refund. To qualify for this refund, please ship the items whose claims were granted back to the seller in their original condition and keep your tracking information. You are responsible for shipping and handling costs.

And I get no other options other than

    1. Shell out on postage and Provide tracking information
2.Cancel claim.....and this is what the seller and paypal would essentially like me to do.

? Like what can I do in this instance?

This is how eBay works. Either pay for registered post return, or leave it go. There is no other option.

you made the mistake of making the paypal claim as "not as described"
you should have done it as "item no received", and because it wasn't sent to you by registered post the seller would have no proof you received the item, and paypal would then rule in your favour

jus send it back normal post and then keep the reciept and use the reference on the reciept as tracking..the seller or paypal wont know its not a tracking number.you'll just have to take a chance and hope it doesnt go missing..i always use normal post without any problems..

 Do NOT do this, because they can most certainly tell if it's a tracking number or not.

Sounds like the only thing you can really do is leave negative feedback.

Yeah, REAL STINKY Feedback - What the worst thing a buyer can say in a feedback situation? I did tell him that i'd leave bad feedback, and he gleefully told me that he did'nt care.

He should care , - negative feedback will affect his sales on eBay

    lmao at that.

I can categorically advise that this is not the case. OP if you do this in a dispute you will have no proof of returning the item to the seller.

Except he'll likely get it removed as unjustified feedback by eBay due to offering refund.

So, I left some Bad Feedback for him - and Ebay object!

    Dear user,

Terrible ebayer,Rude,Argumentative and sells FAKE Rubbish CHINEESE MUCK! :(

Like..........WTF? I can't even leave bad FB for him now? GRRRRRRRRRRRRRRRRRRRRRRRRRR.......

They were never going to let that one remain. It's far too argumentative and speculative.

    yeah, but its factual.

    Grrrrrrrrrrrr

Fake rubbish Chinese Muck, that's not factual, they may have even thought it was a bit racist.

No one reads the comments anyway. Leaving negative feedback with a simple short comment is the best thing to do. Non genuine items or something like that, or even just one word; Fake and nothing more.

Ohhh, play the racist card........not the case.
The product was a fake chineese made piece of tat, is all.

  • Closed Accounts Posts: 16,713 ✭✭✭✭jor el

Whether it is or is not, is largely irrelevant. Calling it Fake rubbish Chinese Muck was never going to be left there by eBay, and they could possibly have seen it as a racist comment, or perhaps just as an over the top and emotive comment. Whatever the reason, they have removed the comment, and you've been left with no further recourse.

IMO that comment is more likely to be removed for the personal abuse as opposed to the factual aspect (Im sure ebay are aware that most items from china are not real)

What was it? you can get a refund without sending it back but your gonna have to get a letter from a shop verifying that it's fake.
