Question about Penalty points

    Not sure if i posted this in the right section

    I got points and a fine today because i was about to ring someone while i was sitting at the traffic lights the unmarked garda car was sitting beside me and beeped at me i put the phone down and the lights went green a short time later and they flashed and pulled me over. The law states you can not use a phone while driving. would i be put under that law? is sitting in your car while the engine is running classed as driving?

    Yes. You weren't parked, you were temporarily stopped in the middle of the road at traffic lights.

    Yes as above you weren't pulled in you were simply stopped in traffic, you are still required to maintain your awareness of the road and whats around you, which you didn't if you picked up your phone.

    I was stopped in a traffic jam and answered the phone.

    Garda going the other way told me to pull in. I got the fine and points.

    Whatever about using the phone, if I hadn't seen the Gardaí in the car beside me i'd slink off into a corner and pay my fine quietly.;)

    Actually the law states that you can't hold or support a phone while driving. So even the mere act of picking it up or leaving it on your lap could get you into trouble.

    your at nothing fighting it in court you run the risk of more points if you lose
