Age policies on clubs etc...

    What's the deal? is it illegal to refuse anyone who is over the age of 18? Say apart of course for private members clubs.

    I have been told in the past that if you are refused without good reason you have a right to ask a Garda to face the doorman and explain the reason why, if no good one exists, you are a decent character with no record etc., they are obliged to let you in.

    Now i'm past the stage of, well in large, getting refused entry from clubs but would like to know what the actual laws are on this matter.

    If you are talking about operating over 21s/23s/etc admission policies, then it's perfectly legal. The Equal Status Act says that operating age-based admission policies on licensed premises shall not constitute age discrimination (or something along those lines).

    When did any club ever refuse someone for being over a certain age or are you trying to join the Boy Scouts?

    I think what the OP is trying to find out is can a bouncer refuse you entry to a club because he doesn't like the look of you(citing reasons as your too drunk when you are completely sober with barely legal girls falling in the door). The answer to this is 'no'. The Door Security Personnel are required to give a valid reason for why they refuse entry, otherwise you are perfectly entitled to ask a member of the gardai to assist you gaining entry into the club. I'm not sure what the story is with issues such as not having shoes or wearing a 'hoody'.

    You can ask a Garda all you want. A Garda can't force a club to let you in. It's a civil matter.

    The Equal Status Act originally provided that bars could not refuse a person over the age of 18 on the basis of their age. i.e. Over 21's policies were not legal. The Act was subsequently amended (after pressure from publicans) to get rid of the age provision- thereby allowing licensed premises to discriminate on the basis of age.

    I dont think there is much you can do here because as k_mac said its a civil matter unless you can show you are being discriminated because of any of the following:
    • Gender: male, female, transsexual
    • Marital status: single, married, separated, divorced or widowed
    • Family status: pregnant, parent to child under 18; primary resident carer
    • Age: persons aged between 18 and 65
    • Disability: includes physical, intellectual and emotional disabilities
    • Religion: different religious belief, background, outlook or none
    • Sexual orientation: heterosexual, homosexual or bi-sexual
    • Race: includes ethnic, national or racial origins
    • Membership of the traveller community
