Entitled to Compensation?

    Hi
    I was assaulted outside a fast food restaurant last night. My face is badly bruised. I tried to stop a fight from starting and I came out at the worst end of it. The whole thing was caught on CCTV. Am I entitled to be compensated for my injuries?

    See a solicitor and ask him/her to start a civil suit for assault. If there is any class of a Garda investigation going on this will hold up any civil action as a civil action cannot proceed until all associated criminal proceedings are completed.

    It would probably be in your interests to see that the matter is reported to the Gardai, otherwise you are open to the accusation that it was so minor that you didn't report it and so you shouldn't get any compensation.

    you made an effort to jump right in there and didnt expect to get injured ?

    and because you were injured - you want to sue someone.....no offence to you but its just the same as walking across the M50 and suing someone if they hit you (assuming you live).

    SECONDLY:
    Did you suffer any serious injury ? or just someone hit you and you not have a bruise/scratch on your face/body...... because I don't think you have much of a case, you choose to enter into a danger zone - and the first thing you do afterwards is try to find out if you can sue.

    by all means try to screw the insurance companies into giving the rest of us increased premiums (dont know if thats the correct plural of premium) ...but if your claim fails - you will have a fairly expensive legal fee to pay.


    Hopefully you were not hurt seriously - but in my opinion you only have yourself to blame, if you know some of the people involved (because you claim its not a problem to find them to issue proceedings) .... then you might find that they will counterclaim.

    I do find it odd that you've already seen the CCTV footage - were you working at the time - if so, you may have a claim against your employer for not adequately protecting the premises.

    I'm sorry but thats in know way like walking across the M50. I was preventing an assault from taking place.

    I think I have a solid case. I didnt suffer any serious injury but who knows some where down the line I might develop some emotional stress?
    The first the thing I did was call the police and then went to doctors and then found out if I could sue.

    Myself to blame? You may be in the same position someday, defending your girlfriend or a family member

    You've prepared a pretty weak case. You should work on my defence instead

    :pac::pac::pac::pac: I'm emotionally stressed reading this! You attempted to stop an assault what did you think was going to happen, the person was going to give you a box of chocolates :confused:

    you stopped the assault be happy and dont go trying to line your pockets especially on a day where the average Joe has been once again completely fcuked over on the financial front.

    If you want justice done go the legal route and send the person to prison rather than looking to profit.

    What are the chances of the individual who assaulted you of having any sort of insurance to cover him? It's all well and good getting an order for compensation to be paid to you but actually getting the money can be a whole different story.

    fully agree, looks to me like your looking for a handy touch, if you have no injuries bar a bruise move on and be more careful in future, entitled is one of the most over used words in this country..
