Shop fittings

    I had a small menswear shop in Ashbourne , that has since closed down.

    I have just discovered that the landlord has removed my shop fittings and given them to another store that has just opened. where do I stand on this matter.
    Have i given up ownership when we closed or are these goods still mine?

    Yes we paid for the entire shop fit. The shop has been empty for 1 year+ if that makes a diference

    So you mean you abandoned them in the landlords premises for 1 year without paying for the storage as you no longer had use for them?

    If thats case would you not be happy that someone is getting a bit of use out of them?

    Did you ever request for the fittings back? - If not then it would be assumed that they were abandoned.

    If you owe the landlord money and he is trying to get it, then the value of the fitting could be part of a defence against the amount due. - This would then put any court date back about 18 months especially if the amount is over €6350.

    Unlikely to succeed but it buys time.
