What are my rights?

I thought this forum would be the best place to ask this question. Basically, I went in to a Volkswagen dealership at the start of July and ordered a new Polo. I bought the car under the 2010 scrappage scheme as I had an old car to scrap. I ordered a few extras on it and I was told the car would take 3 and a half months to be ready for me to drive. I should have got the car in mid October. However, once mid October came and there was no sign of the car, I rang the dealership who told me that it was going to take another month to arrive, now leaving it mid November when I'd finally get my car. However, the dealership were not in contact with me since mid October and yesterday I decided to go into the dealership and speak to the man I ordered the car from to see what the story was. Obviously it wouldn't make sense me driving around on a 2010 plate for a month. The man I dealt with told me that the car had only just been built and was going to take 6 weeks to arrive in Ireland, meaning I'd get the car just before Christmas! I told him this wasn't acceptable. My question is what are my rights here? It looks the scrappage scheme is not going to be extended into 2011. I ordered the car under the 2010 scrappage scheme and got about ?3,500 off the price of the car. I have a receipt saying how much the car should cost me. However, the dealership might turn around and tell me to take the 2010 car in December which would be completely unacceptable in my opinion. Do I have the right to demand that Volkswagen give me the car to register in January 2011 and honour the scrappage scheme price?

The scrappage is more then likely going to end this year. If you take delivery next year you won't be able to use the scrappage deal.

You can walk away if you want, they haven't delivered in time so the contract is void. Or if you plan on keeping the car for 5+ years then take it as it won't make that much difference when you go to sell it.

If the scrappage scheme is going to be extended into 2011 then I am sure you will be allowed register your car in January 2011.

If not and you want to avail of the scrappage scheme, then you will have to take your car in December 2010.

What did the Dealer say when you said you did not want to take the car just before Christmas?

The Dealer at the minute does not know if the scrappage scheme will be extended. There are different takes on this. I had heard that scrappage would be extended for six months, but that was before all this recent IMF Economy stuff.

Dont get the obesity bit either.

Could a mod change the title back to 'What are my rights?'! Don't know how that happened!

    Whats the issue?

Let the car get delivered but tell the dealer not to register the car until January so you get a 2011 plate.

but if the car isn't registered until 2011 she won't be entitled to the scrappage would she?

The deal is done. All she simply has to do is refuse to visit the garage until January and say that she agreed earlier delivery and she is far too busy. She will sign on the dotted line in Jan which means they cannot register it or at least shouldnt be allowed.

Its their problem. Their a dealership, they will be allowed to cook the books, booked a fake car etc to make it work.

    Frankly, its their problem.

With the way they have been fobbing of the op already what are the chances it wont arrive until Jan anyway, then they wont have any choice but to register it in 2011 and still honor the op's deal.

If the deal was ageed months ago, get the garage to contact the relevant government department to explain that although the deal is done and signed, they won't be able to deliver the car until January. Get whatever official to send out a note saying that the scrappage will be honoured as the customer (you) acted in good faith, expecting the car to be delivered in October but now having to wait.

It might work (or it mightn't work).

Why don't you just get the car when it's ready? The reg on the plate isn't going to change what it is...

The scrappage deal is part VRT based, part dealer. If the scrappage deal isn't extended to next year and I doubt it will, then no mater what books the garage cooks for the OP they won't get the VRT rebate if they try to get an 11 reg.

The OP can either take the car when it's ready or walk away. They will then have to try and find the same deal next year when taxes have gone up in the budget to get a precious 11 plate.

Getting a car in October or December doesn't make much difference to the price when you go to sell it as it'll still be considered a 10 car.

The customer doesnt have to sign a thing for the dealer to register the car Berty. They can do so at their own discretion.

If the car is registered in Jan, it will not qualify for the VRT discount, which means the car will be more expensive.

If it were me I'd just take the car when its ready. See if the dealer wil throw in some extras for the hassle.

I think you should do your sums and make your decision. If the scrappage saving is greater than the depreciation you'll suffer by registering it at the end of the year then you should register it at the end of the year. The opposite obviously applies also.

I'm pretty sure the back of the order form/contract you signed stipulates that if the car is delayed that the dealer isn't financially liable for any losses incurred (or whatever wording they use).

You can't make the dealer sell you the car at the agreed price if the price has changed due to a taxation issue.

If it were me I'd wait till December to register it.
Let the car come in and get the dealer to hold it. Tell them you're waiting until the day after the budget to register it.
If the scrappage scheme is definitely cancelled, register the car ASAP. If the scrappage scheme is extended, instruct the dealer to hold the car and register it in Jan.

    Simples! :)
