P45 and PRSI contributions

    Hi, I started a new job about three months ago. I mislaid my P45 from my previous employer from 2008. I went to the revenue and am waiting quite a few weeks now for my emergency tax to be sorted. The problem is because my employers don't have my P45, I nor my employer are playing PRSI. I am on a temporary contract and am worried that when I finish work I will not have many PRSI contributions to avail of any support. Will The PRSI which should have been paid be reimbursed or has that been lost for good?

    As far as I know, if you're on an Emergency Basis of tax you still should be paying PRSI (depending on how high your salary is of course).

    What I would advise you to do is fill out a 12A Form (available on Revenue's website) and give it to your employer and then they can fill out their section and send it off to the Revenue so you can get your Tax Credits for this year. Waiting for the 2008 P45 is a waste of time I think.

    Thank you for your reply. I am on a little above minimum wage but am working up to 35 hours a week, and not paying PRSI. I asked my employers why I wasn't making PRSI contributions but I am still confused about whether I should be or not. Am I correct in thinking that when my temporary contract finishes. if I am without contributions I would not be entitled to the dole if I cannot find another job?

    That's nonsense. It is the responsibility of the employer to operate PAYE/PRSI on your pay. As long as they have your PPS number then they can (and should) be paying PRSI on your behalf. It can't be held against you if you have worked for a period of time and your employers made a mess of the PRSI; once you can prove you worked you'll be entitled to the credit for PRSI purposes, so don't be worrying on that front.

    I think what may be confusing you is the fact that YOU personally are not paying any PRSI. If you earn less than €352 in a week then you, the employee do not pay any PRSI. However your employer is obliged to pay a contribution (Employer's PRSI) for you. This doesn't come out of your wages, it is a cost of employing staff, that applies to all employers. Based on the figures you've quoted then you aren't earning enough to be having any PRSI deducted from your wages.
