Can I write off my van??

    Right the van was in a tip a while back, 3rd party involved, Allianz have just come back with a quote to fix the van at €2,999. I've the van insured with them for €3,500, can I tell them to take the van & I'll take the cash & run????

    Or you could just tell them to make out the cheque to you and you can keep the van aswell.

    Ah I'd to bring the van to an Allianz approved Pannel Beater,

    Surely they'd make the cheque to him??

    Nope,
    Allianz have decided that €2,999 is what it will take to put you back in the position you where in before the accident (thats why you pay insurance).

    What you do with the money is nobodys businees but yours.
    You can fix the van or spend it on coke and hookers!

    Ring them up tell them you are happy with the estimate but you want the
    cheque made out to yourself.
    Makes no difference to them, claim is settled either way.
    Approved repairer is used to calculate estimate, that is all.

    I am suprised they didn't offer to write it off with the repair cost being so close to the valuation. Either way, the cheque is yours.

    Yeah that happened to me once. Got crashed into, got quote of 1,750 to repair from insurer recommended body-shop, car was only worth about the same. Got cheque, spent 700 quid getting it fixed and bought a new laptop with the rest, happy days :D

    As far as I know, if you take the cash option, they pay out less the vat ('cos they can claim back the vat) and less any excess on your policy. 2999 less vat is 2642.

    Thats news to me and in my own personal experience is incorrect.
    Obviously any excess will be deducted, that goes without saying.

    as a 3rd party claimant anyhow, I got the check for the amount of the quote, inc VAT.

    While Alliance may be able to claim VAT back on a bill, is it not the case that they are paying the bill, but the claimant is the person for who the work is being done?

    Note: it seems that the OP is claiming against his own insurance, rather than claiming against another persons, so excess does come into play.

    Insruance companies cannot reclaim VAT as they are exempt I would have thought, and also have to pay out VAT inclusive.

    just becareful on your valuations.

    You have insured an interest of €3500 in your van. If the van is actually worth about €5000 for arguments sake and the damage is estimated at €3k you will only get a payout of €2100.

    At least this is my understanding.

    Think about it, you could insure your new Aston Martin for €20000 and when you do €40000 worth of damage to it, would you expect the insurance company to pay out the full amount of the damage?

    Insurers always have the option to effect reinstatement, which basically means they can insist on repairs being done. In practice, they are unlikely to bother for a small claim like this, but it is their right.
