negligent solicitor

    Before a bank releases a mortgage cheque, does the solicitor acting on behalf of the purchasers give an undertaking to the bank that all correspondence is in order, ie compliance cert, deposit cheque ect??? In our case it transpires that we didn't have a compliance cert for our brand new house even though it was a fundamental part of the contract for sale. Yes, we were meant to but have just discovered we didn't!!!!!:confused:
