The purpose of this thread is to provide a place for to list all regulation documents relating to to architecture, construction and planning in Ireland. The list will be made up of Acts of the Oireachtas, Statutory Instruments and explanatory documents such as technical guidence documents.

It is not a discussion thread, and if they is any elements not listed that you feel should be included please PM your suggestion to a mod or started a new to discuss the issue, where required.

"]The Building Control Act 2007

In summary, The Act provides for the following.

1. Strengthening of Enforcement Powers of Local Building Control Authorities,

•The Act amends the Building Control Act 1990 by introducing revised procedures for issue of Fire Safety Certificate by local Building Control Authority. It also introduces a Disability Access Certificate (DAC) to be issued by local Building Control Authorities for new Non-Domestic Buildings and Apartments.
•The Act widens the right of building control authorities to seek an Order from the High Court or the Circuit Court to stop work on certain buildings. It introduces the option for authorities to bring summary prosecutions for all building code offences in the District Court and it also increases the maximum penalties for breaches of the national Building Regulations.

2. Registration of titles of certain Building Professions.

•The Act provides for registration of the titles of “Architect”, “Quantity Surveyor” and “ Building Surveyor”. The registration scheme will be administered by the Royal Institute of Architects of Ireland and the Society of Chartered Surveyors.
3. Legal Transposition of relevant parts of EU Mutual Recognition of Professional Qualifications Directive (2005/36/EC of September 2005).

•The Act takes account of the adopted EU Directive 2005/36/EC of 7 September 2005 on Mutual Recognition of Professional Qualifications

The Building Regulations
The primary purpose of the Building Regulations is to provide for the health, safety and welfare of people in and around buildings. In general, the Building Regulations 1997 - 2002 apply to the construction of new buildings and to extensions and material alterations to existing buildings and to certain changes of use of existing buildings. These Regulations apply to all types of construction.

The Building Regulations are couched in broad functional requirements, or general statements of intent of the relevant regulation. For instance, the Regulations governing Access and Use of a building in Part M is stated as:"Adequate provision shall be made to enable people with disabilities to safely and independently access and use a building". Technical Guidance Documents A to M give guidance on how to comply with the Regulations.

Certain parts of the regulations (listed A to L) apply to material change of use of a building. The second schedule lists the various parts (A to M) and the regulations within each part. The third schedule lists the types of buildings that are exempted from the Building Regulations.

Technicial Guidence Documents
The Technical Documents, commonly known as TGD's give guidance on how to construct a building so that it complies with the Regulations. Where works are carried out in accordance with the TGDs, this will indicate compliance with the Regulations. The adoption of an approach different to the TGD's is not prohibited, provided that the approach meets the requirements of the Regulations.

The Building Control Authority may require such evidence in the case of an approach different from that given in the guidance to ensure that the building does comply with the regulations. Important to note that neither the Building Regulations or the TGDs promote the use of a particular product or method of construction - nor do they favour masonry construction over timber frame construction.

Code of Practice for Wastewater Treatment Systems for Single Houses

This code of practice provides guidance on the design, operation and maintenance of on-site wastewater treatment systems for single houses (p.e. less than or equal to 10). It will assist authorities, developers, system manufacturers, system designers, installers and operators to deal with various systems.

I printed off the new Part L today along with all the supplementary documents on boilers & construction details for air tightness... flippin hell - it's a mountain of paper - I reckon it's got more information in it than the entire Building Regs when they first came out!

Anyone fancy posting a summary....?? !

For the sake of completeness I note it goes on to say

However, the foregoing document may
continue to be used in the case of dwellings: -
- where the work, material alteration or the
change of use commences or takes
place, as the case may be, on or before
30 November 2011, or
- where planning approval or permission
has been applied for on or before 30
November 2011 and substantial work
has been completed by 30 November
2013.
“Substantial work has been completed”
means that the structure of the external walls
has been erected

The Planning and Development (Amendment) (No. 3) Regulations 2011 became effective on 21/09/2011 and will result in invalidations among other things from October 17 if not adhered to.

Changes to public notices and application form and application contents should be noted.

while it makes an attempt to refer to Part B fire, its a pity its not more prescriptive in its detail. Simply requesting refererence to Part B isnt good enough IMHO
