    Never produced my details into the cop shop nearly a year and two months ago,lame excuse but was moving house and forgot bout it, car was goin for nct so car was out of tax and nct as you can't get a tax disk without a valid nct, since failed nct and car off the road completely since sept 09, bought a new one same month. I was told told that a summons was issued for me, but as of yet it has not been served but have since never heard anything. Is there a time frame that you must be notified of a summons, i know they can produce it up to 21 days before the court case but has time lapsed too far now or should i be waiting for the postman still?? The incident happened back in Sept. I have heard a summons being issued nearly a year after the incident occured. I will probably get done for driving with no nct, but date due was the following wk, no tax, but couldnt get tax cause car was out of nct! What should i do and what should i expect when the time comes, if it comes, I know its lying in a desk drawer waiting to be handed out!

    You don't need valid NCT to tax your car.

    Go to the Garda that is dealing with the matter, explain the situation and bring proof that the NCT was the next week. Bring your current NCT, Tax, Insurance for the new car and the failure for the old car and/or any tax and insurance documents you may have for it that are relevant to this time (I don't know how you'll prove that you are not driving the old car) and Drivers Licence with you.
    Explain the situation to him and explain that you believed that you couldn't get tax until you had NCT or whatever your story here is.

    Don't just sit around and wait for your summons or worry about it. It's a waste of time and money to do this.

    The Garda will deal with the matter as he sees fit. If he still wants to go after you for no Tax and no NCT then he will, but at least you'll know there is a summons coming through that door.



    Next time try typing in paragraphs if you want a response quicker. It's very difficult and time-consuming to try to read block text like that :D

    You don't need valid NCT to tax your car.
    Correct since (I think) 2005, but I think they haven't bothered to change the forms in the office yet. It's not there if you do it online though.

    With summons being all computerised now I'd have thought that if he didn't hear anything after over a year that the Garda has forgotten about it. Maybe he lost his notebook or got promoted or moved down the country or moved to the detective branch, there are all sorts of reasons why people don't hear anything after the event.

    I wouldn't approach the Garda at this stage, let sleeping dogs lie.

    A Garda must post the summons to your address 21 days before the court date and register same, that is true. However, a Garda can hand deliver a summons to you up to 7 days before the court date.

    The Garda has to initiate proceedings within 6 months of the alleged offence for summary offences and as there is no sign of a summons after 1 year and two months I think it's safe to assume that there are none on the way.

    OP said incident happened in September... it would not be unheard of to not have received the summons yet.

    The OP said they were in the middle of moving house when this all happened. If the OP didn't update the registration details for the car, the summons if issued, would have been served on his old address.

    Hi just to sort out a few issues on it,

    Thanks for the advice on Bullet points, will do that in future.

    1. Moved out of my parents house so if summons went there i would still have gotten it

    2. I actually rang the tax office and they told me that no tax could be issued without a valid NCT unless i got a muppet in there that didnt know.

    3.The incident did happen in Sept 09.

    4. Still confused as to whether i can still get a summons, i'm sure the court date would have come and gone!
