Travel Insurance Claim Issue/Advise

    Will try to keep this as short as I can but it is a long story :(

    Back in August myself and my fiancee went on Holiday to South Africa.
    Flights from Dublin to Heathrow with Connecting flight to Cape Town. 3 night stay in cape town with Shark Cage Diving booked and Pre-paid for on our second day in Cape Town, the 3 night Safari before returning home.

    Now our problems began in Dublin Airport, our flight from Dublin to Heathrow was delayed, no proper information communicated to passengers and when we eventually got the flight over to Heathrow, we had now missed our connecting flight onto Cape Town, as there were no other flights to Cape Town until the following evening, the airline had to reschedule our flights (via Johannesburg this time) and arrange accommodation for the night.

    As a result of this we got to cape town over 25 hours later and missed out on 1 night at our hotel in Cape Town and the Shark Cage diving which we had to Cancel. Total Cost for Hotel and Shark Diving was just over €700.

    When we argued with the Airline staff about who was going to refund us for the loses incurred we were advised to send claim request through the airlines website and that they would deal with it.

    We got back and had to wait for a Cancelation invoice from our travel agent to be issued to us and then we sent a big long letter to the airline with all the details and information i had. It took over 28 days before we got a response advising us that the original delay was due to a technical problem with the aircraft and another plane had to be brought in (so they admitted/confirmed the fault was on their side) but then basically told us that they would not cover any of these cost and we would have to go to our insurance company.

    We then sent on all the details to our insurance company and just got a response back today basically telling us that they wont cover it and to go back to the airline.

    Really starting to wonder if we will ever see any of the €700+ back at all at this stage. Anybody know what further steps I could take in relation to this?

    It seems that you were properly looked after on the day (rebooking and accommodation) but the issue of compensation is a little iffy, and I'd imagine the insurer will fob you off forever. Generally the airline will claim that they aren't responsible for consequential losses, but you should take a look at http://www.eccireland.ie/topic.php?topic=1#subtopic_43. It cites several cases which decided that long delays should be compensated in the same way as a cancellation. In your case (over 3500km) that would entitle you to €600 each. If I were in your position, I would write to the airline citing those judgements and insisting on compensation. Good luck.
