Paypal claim via adverts

    Ive been on adverts/boards about 3 years and have nothing but good feedback.Ive just sold a used Nokia E51 to a buyer on adverts who has quite a bit of negative feedback(which in hindsight i wish i had stayed away from him).
    He has opened a paypal dispute as he says he did not get the phone as i described.He got the phone "exactly" as described"-The phone is in excellent condition.I sent it registered(still have reciept) and low and behold he opens a paypal dispute with me.He says there is something wrong with the on/off button-it has a small bit of cosmetic wear(just like any on/off button of any used item would have) but he now says its broken and the phone is broken from one side-in no way was it broken.I see he buys and sells phones only so no doubt he wants everything absulutly immaculaute so he can sell the phone on again at a profit.
    I have Pm'd him back on adverts and i have contacted him via paypal.Ive never been in this situation so would like some advice if possible.
    I would be willing to take the phone back from him and refund him the money if i knew that the phone was "exactly" the same as it was when i sent it and that everything was intact and working correctly-but how am i to know this?take his word for it?Is there a way i can get a guarantee from paypal that ill recieve the phone and cables etc in the same way as i sent before i give him the money back because if not then why would i refund him?
    Surely paypal have some sort of system to sort out my particular problem?Am i being to nice to this guy also for even considering refunding him when i know ive done nothing wrong?

    Paypal won't guarantee you anything, so if he sends back a broken phone to you (because either he broke it or it got broken in the post) then you'll lose the claim.

    First thing is he will have to send it back to you.

    Thanks Jor el,ill contact him so see if he will send back the phone first-cant see it happening to be honest,if he doesnt then he can start up the whole dispute thing,ive done nothing wrong in my eyes so i should win any dispute.

    You have his home address, tell him you will pay him a visit to discuss what's wrong.

    From my experience of selling stuff on eBay, paypal generally take the buyers side even if you can prove delivery via a tracking number etc.

    If the phone does get returned, make sure you agree to issue a refund only after you receive it back and make sure it's the same IMEI that you sold (in case a swap was done with a faulty one).

    I'm not making any comments/judgement on the honesty of the buyer, just stating what I'd be looking out for in case someone tried to pull a fast one !

    Not in a non reciept case, if delivery at the buyer's address is confirmed how could this be ignored? Proof of delivery is not relevant if the buyer has already stated that the item was recieved but is not as described.

    I'd also reccomend that, if this should happen (swapped/damaged/altered item sent back) that you contact paypal ASAP to ensure that the buyer doesnt get awarded a refund on a fraudulent basis (if they dont send the correct item back)

    Cheers for the advice lads.Wouldnt fancy calling to his house,hes already tried to sell me back the phone at a discount and hes slanderized my feedback saying hes lost all his money!?-says something of his character.Hes supposedly sending the phone back to me today and i should recieve maybe tommorow.Ill be sure and give it a good going over before issueing any refund.Crazy carry on...

    If it does arrive with out you signing for it and it is not the same phone / broken then simply claim it never arrived since it is the sender's responsibility to prove that it arrived (and as noted Paypal don't really care what you get back).

    Well it will be coming registered(otherewise hel claim it got lost in the post or something) so i will have to sign for it.So i guess its the lesser of two evils really......

    Actually, it would be you that could claim it got lost in the post, not him. Since he's returning it, he needs to prove you received it. If he sends it by regular post, then you can simply claim it never arrived, he won't be able to prove otherwise, and he will lost any claim against you.

    this happened to me very recently in relation to baby clothes i sold. i had pictures of the clothes. sale was agreed, payment received through paypal and i posted the clothes. next day i get email from paypal saying the buyer wanted a refund. i refused to give refund. The buyer saying the clothes were not in good condition. Some of the clothes had never been worn. I kept receiving emails to refund the monies and i refused until the clothes were returned. She kept threating a paypal dispute and i told her that if she didn't open a dispute i would. apparently under the paypal terms when a dispute is opened they can order goods to be returned at buyers own cost. eventually she returned my clothes and i refunded the monies. This is a scam. Hold your nerve and refuse to issue a refuind until you receive phone back.

    Ya,im not gonna buckle-ive done nothing wrong.Ive been given a tracking number plus an apology,hes certainly changed his tune thats for sure(maybe it had something to do with Claire from the adverts.ie support team getting involved).Very intrested to see what comes tommorow.All i want is the phone and everything i sent with it back in the same condition and ill be happy.Wont be holding my breath tbh after reading some comments here and judgeing by some of his PMs...............Then again i could be wrong

    Sunday Night.I posted Tuesday,he had it wednesday and he filed the paypal claim on same day.....
