Transporting a Corpse and the Law

    DIY everything is the latest rage in the recession. So it got me thinking about DIY one of the biggest events in our life/death. Can anyone transport a corspe in Ireland if you want to cut out using an undertaker? Or is there specific laws that govern this? Could I use a courier or truck backhaul to the graveyard/crematorium?

    There are a few common law offences relating to not burying a body within a reasonable time and exposing a body in a public place to the outrage of the population or something similar but I don't believe that there is any statute or common law provision relating to the transport of a body within the state as part of a normal funeral.

    What I mean by this is that if a person dies in Donegal and there is no involvement by the coroner (i.e. a doctor issues a death cert. and the Gardai aren't involved) then there is no paperwork or official permission required if the family want to take the body to Wexford for burial. Even if the coroner is involved, he/she will eventually release the body to the family at which stage they can take it anywhere in the 26 counties for burial with no further involvement with the authorities.

    The main statute law in this area is the Coroners Act 1962..

    In answer to your question, you do not need a licence or permit of any kind to transport a body so DIY is ok as long as it's all done in a fashion that doesn't offend the public generally - if you wanted to transport a coffin to the crematorium in the back of a transit van you would not be breaking any law.
