    Howdy

    I just had a big arque with local scumbags and a garda patrol.

    I have received life treats and information that tommorow my house will be on fire in a very racist way. I informed garda, but gardai said he can't do anything about this, other then see me on monday and write down a statement.

    Is it true?
    Can I do something to protect my property? It wouldn't be a problem other than the fact that my home insurance expired.

    Help!

    Threats to kill or cause serious harm.


    5.—(1) A person who, without lawful excuse, makes to another a threat, by any means intending the other to believe it will be carried out, to kill or cause serious harm to that other or a third person shall be guilty of an offence,


    (2) A person guilty of an offence under this section shall be liable—


    (a) on summary conviction to a fine not exceeding £1,500 or to imprisonment for a term not exceeding 12 months or to both, or


    (b) on conviction on indictment to a fine or to imprisonment for a term not exceeding 10 years or to both.

    I do not think it would be against forum charter to recommend you renew your home insurance now. This is not legal advice just good advice.

    On the off-chance this is serious then I'm sorry for your woes and you should go to the Garda station and insist they take you seriously.

    Yeah I'm thinking it's a troll. My insurance wouldn't be my first concern. Just renew it.

    I'm not sure he's a troll based on previous posts. If there is a threat, report it to the Gardaí - if there is a problem with the Gardaí speak to a higher up at the station or the Garda Ombudsman.

    I wouldnt take this lightly. A foreigner was killed in a town near me last night, probably over some ridiculous drunken racist macho BS. If my life was threatened, I'd leave that particular part of the world immediately and permanently.

    Go to Garda station. Arrange time to have statement taken. Make statement. They'll do the rest and consider charges under Section 3 Criminal Damage Act 1991, Section 6 Public Order Act 1994 and Section 5 Non Fatal Offences Act 1997. The latter will not be considered unless you felt the threat was really genuine (in other words the "scumbags had the capacity and capability to perform such an act - have they done it before to other people?) And after you make your statement and then they don't burn your house down or kill you you'll still have to give evidence in court in relation to any charge the DPP/Gardai feel they should bring.

    Do this though. IMO the only way to deal with this type of behaviour is to stand up and show that you are not going to take it.
    But do so through the correct means.

    This is odd on a couple of levels. Firstly, the fact that you come on to an internet forum such as this seeking assistance when the issues you face are so serious.

    Secondly, even more bizare when you say here:

    @kayroo - for me it is, as with insurance i would have "something", without i wouldn't have a place to live.

    @detecive - soo far my house has been okay. when i made a call tonight, they have send two fire briages and four garda cars (two big ones) withing 10 minutes. Since then it's been quitet, but who knows... Staying up this night. Got meeting with gardai to give a statement tommorow at 8am.

    They are capable. Couple of months ago they have set a store owned by pakistanis on fire, because they reported them for stealing to garda. Oldest "child" in that family has recently came out of jail. Two of their uncles were shot near liffey valley (if you live in south dublin) couple of months ago too (It was in news papers).

    And how would I be able to do that? It will be my statement against theirs.

    I did, because gardais did nothing. Guy that i was dealing with that night, said they will not do anything until something actually happends. I'm also welcome to meet him and give a statment, which might be later on brought to court. That's literally all he did.

    I already had lost a house to a fire before, thou it was electric failiure.
    I know how it is, and trust me, if you are alive then 1st thing you really care if you will afford to live in some other place, and that is what house insurance is for.

    This is of course awful stuff on the OP's account.

    There is however no legal solution here, least of all one that can be got from responses on an internet forum.

    Its a police matter.

    Your primary consideration wouldn't be for life and limb? Having somewhere to live is only a relevant consideration if you are actually alive. Ensuring his physical safety would always be the primary consideration.
