Smoking in the home

    Hi all

    My job involves going into peoples homes, and I'm just wondering since that persons home then becomes my place of work, are they legally allowed to smoke while I am there?

    The law in question specifically excludes private homes from the smoking ban:
    Public Health (Tobacco) (Amendment) Act 2004
    Subject to subsection (7), the smoking of a tobacco product in a specified place is prohibited.
    ...
    (7) This section shall not apply to—
    (a) a dwelling,
    A polite request will probably get you further anyway.

    And if they don't stop smoking after your polite request simply walk out the door. Your health should take priority over some dummy that feels the need to force others to inhale his/her toxic fumes.
