Job advertised whilst still filled

    Bear with me here, it might get a bit complicated.

    I work for Company X which hires it's premesis from Company Y. Company Y has decided that they want to take over the running of those premesis themselves and has dissolved the contract with Company X, we have to be out at Christmas. The thing is that they are currently advertising for the role of Manager X, but there is still a Manager X and will be for some 10 more weeks. This is annoying current Manager X.

    My questions are these:
    Can they advertise for a role that is currently occupied (there is no start date on the ad)? I have a feeling that they feel they would be entitled to do so.

    Should they have adverised internally first?

    Is manger X on a continuous or fixed term contract?

    I.E is manager X in a permanent role?

    will the new position be with company Y - if so then the position in company X is probably redundant

    and if so has manager X applied for it ?

    Manager X would not want it, nor would they get it even if they applied.
