Contract Extension

    Hullo

I’ve been reading through the posts and checked out oasis and citizens advise but can’t quite pinpoint the answer to my question.

I am on a fixed term contract (with a view to permanency) – first for 9 months, then it was extended by 3 months and it has been extended further by 3 months…………. How many times can my employer extend the contract before a definitive decision has to be made!

Can they continuously extend this for years or do they have to hire or fire me for good at one point?

    Thank you

your contract should have some detail on the terms of extensions or it should by rights have.

also there is a rule in law about a contract been renewed 3 or 4 times has to be made permanant at the 4th time. I stand fully corrected. However I think this is only to do with the renewal of contracts not their extension.

Check out a union website they might have something on your case

Thanks Gerry - I have rooted around a good bit and I can't find anything definitive!
There is nothing in my contract ...
    It's very frustrating...

You can be on as many contracts as the company wants in the first 3 years, after your third year the company can only give you 1 more contract not exceeding 1 year in which the total is 4 years of service.

After that the company has the option to offer you a CID or permanancy! Most companies will give you the permanancy but i have heard that some dont, they will bring you up until 3 years 11 months and let you go. For this they need a very good explantion why they are trying to get rid of you becoming permanant i.e bad track record, hard times etc etc but this is only in some cases.

Also if your being let go after 104 weeks of you are entitled to redundencey as well!!!!:o

New EU law after 2 years service if your contract is not renewed it is a dismissal!!!! i.e redundencey :D:D:D:D:D

Also if a redundencey situation arises you cannot be picked for redundencey because your a contract worker!!!! if so unfair dismissal ;)
