Private Sale - Any Comeback?

    :mad:a friend of mine bought a car in a private sale for 23,000euro engine blew 2 weeks later .5500 to replace it. he brought the lad to court and he lost had to pay all the costs plus he had to pay the lads wages because took days off work to attend what s sickner :eek:judge told him its was a private sale so he had no guarantee and it was his own fault for not getting it checked by somebody first quote??u bought as is

    Whoever the solicitor that took that one to court should have known better tbh, a total waste of time.

    Your mate should take the solicitor to court for telling him he had a case in the first place

    this is the very reason, i would never buy a car privatly, you have no comeback, has to be a dealer, with written guarantee

    what car has an engine that costs €5500 to replace:confused:

    €23k + €5.5k =€28.5k, i wonder how much a similar car was in a dealers?

    There is nothing wrong with buying private.

    As long as you do your homework first i.e. have a good mechanic check the car out, verify the service history and do the relevant history/finance checks. Some dealer/garage warranties just cover the minimum so the savings you can make by buying private over from a garage can go towards any surprises down the road.

    If you want the piece of mind behind a garage warranty be prepared to pay for it. Buying private to save money and then expecting the same level of comeback as buying from a garage is knieve imo.

    It is an offence under both road traffic legislation and the Sale of Goods and Supply of Services Act 1980 to sell a car which is not roadworthy. Also, the seller is required to give you accurate and truthful information in answer to any questions that you ask. However, a private seller does not have to provide information that is not requested. If you have a grievance after buying a car you should complain to the seller first. If you are not satisfied with the response you may be able to take legal action against the seller. Where the car you bought is unroadworthy, you could also refer the matter to the Garda Síochána and the Road Safety Authority.

    Why not then prepare a list of important stuff to check, and make the seller sign every single thing that he claims they are OK. I.E timing belt last change, engine burning oil, electrical problems, etc. In case like OP's it would definitely help in court.

    BTW. On the other hand, who knows it was sellers fault. Cars break down sometimes, and maybe everything was alright when seller was using the car, and just the buyer was unlucky.

    It would be interesting to hear details i.e. what car it was and was it maintained properly by the previous owner.

    23k sounds like an awful lot of money for a second hand car bought from an individual and I would be very slow to do such a purchase unless it was an unbelievable bargain. I take there was no manufacturer warranty or it was void.

    It really depends on your own level of mechanical knowledge and the surcharge you're prepared to pay for a warranty. I can completely understand why you wouldn't buy without a warranty, but i'd take every case on its own merits. In most cases that leads me to buy privately.
