Emergency tax query, slightly strange

    Hi folks,

    Hoping that you may be able to advise here.

    Basically my girlfriend worked in ireland for about 5 months around the start of 2009. During this period she paid emergency tax.

    When she finished up she asked her employer (KFC) to forwad on her p45 to my address. I never received it but didnt think much of it really.

    Recently we were in ireland and went into the tax office and were told that they have nothing on file at all for her (except one attempt to set up revenue online). They didn't seem to concerned and suggested we contact her former employer.

    She is currently trying to dig up an old pay slip so we can prove she actually worked there (and get her old employee number) but while she does that is there anything else that we can do?

    I find it strange that her employer never declared her tax to the revenue office and also the revenues office lack of concern. I guess this is a regular occurance and not some tax evasion thing (or something :p).

    Next step would be to contact her old employer but apart from that any one have any advice? We are not talking a huge sum here, few hundred euro i guess but for a student that's a useful sum.

    Did your girlfriend register herself with the tax office by completing a form 12A?

    The Revenue's position is that the onus is on each individual to ensure that their tax affairs is in order, so if your girlfrind had not registered herself for tax purposes, and as employed with KFC, she may not have been set up on the Revenue computer system.

    If there was no file set up for your girlfriend on the computer system, if KFC made their annual return for 2009 (called a p35), as your girlfriend was not set up, the pay and tax details would have no file to "slot in" under. This may be why there is no record.

    In saying that though, KFC are obliged to advise the Revenue of a new starter within 9 days, {i think} (Employers Guide to PAYE), and are also obliged to provide your girlfriend with a P45 within 1 month of her leaving.
