Looking for advice.Left the wife sitting in the car while i went in to collect chinese take-away.A passing car drove over a pot-hole in the middle of the road, throwing up stones the size of your fist. One of these stones hit the side of drivers door, leaving 2 nice dents.I dont think the hole was too new as there were plenty of other similiar stones/rocks around the area.
The hole is in the middle of a trench which had been dug across the road and then filled in at some stage.
My question is do i have any recourse with the local county council?

If pothole caused by elements, no, look up non-feasance.

If caused by defective roadworks, maybe, lookup misfeasance.
