"On the spot fines" served by post

    A company I work for has been served an "on the spot fine" under the Litter Act 1997 by post alleging an offence several days after the alleged offence.

    My understanding of "on the spot fines" is that they are for the "found committing" offence as in the authorised person, having found a person or body corporate in the act of committing an offence, issues a fine on the spot to the offender.

    From previous experience in enforcement, matters not dealt with by an on the spot fine at the scene were dealt with summarily.

    Is the Local Authority's proceedure correct?

    If is a littering offence for example Litter wardens go through rubbish and find an address. If its a company they simply sent the notice to the registered office.
