company forcing annual leave

    hi,
    i get 20 days annual leave per year from jan to dec. i have used all of my annual leave for 2010. i could not make it to work yesterday as the road to my home was flooded (live down a small country loan and a pipe burst). called work and let them know.

    back to work the next day and my company are telling me i have to take an annual leave day from next year to cover this. i do not want to do this as that is my 2011 annual leave and i will need it next yr. they will not allow me to take the day as unpaid leave.

    can they force me to use my next yrs annual leave like this? thanks.

    In general there are the following

    Annual leave
    paternal leave
    sick leave
    compassionate leave
    jury service
    carer's leave.

    So, since the only one of them that would fit your situation is annual leave, I don't see why they can't do it.

    Does you company have any written policies on leave, esp on Force majeure leave.

    Most employers would take a sympathetic view of your situation. Usually in smaller firms there is some give and take on these issues.

    Bigger organisations have to have rules.

    However in the private sector smaller firms cannot cope with too much paternal leave, carer's leave etc etc -

    As far as I know, well where I work anyway, you have to apply for unpaid leave. Its pretty unfair really, if you had called in sick this issue wouldn't have come up. Doesn't sound as though your employer is too empathetic, most of them would just go with unpaid leave
