Exhaust Summons

    Got an exhaust summons in the post today. (No Silencer in M.P.V)
    What Im wondering is, do they not need a dB reader to show whether its over the legal limit or not?

    Nope, if the Garda on duty feels the exhaust noise is excessive they can issue a summons without the need to take a reading.

    Were you asked to put in an additional silencer before you received the summons?

    This is a 100% right under the Construction, equipment and use of vehicles act 1963 if a guard deems that your exhaust is too loud then you can be summoned to court.

    OP, PM me under what act you were summoned to court, i can more than likely give you the wording you need to get off..

    to be honest that should be changed. whatever guards decide - its a law...

    its like living in stone age... :rolleyes:

    did they stoped you and told you its too loud? or you just got a summon, which was brought by silver owl?

    I got a summons to for a exhaust noise, i have a modified civic with a loudish exhaust, when the guard stopped me in the town da exhaust had a hole in it makin it louder, i didn't tell her that though.

    nct'd the car 10 days later and it passed, when it came to court i represented myself and showed the judge it passed the test, case closed.

    Same guard 3 days after the court pulled me for my tinted sun strip. told her i wasn't gonna take it down. Went to court I told the judge it didn't interfere with my vision as i drive with my interior sun shield down also, which covers more of the windscreen, case struck out again.

    Highlights the need for an exact procedure to be detailed and pass/fail measurements published to allow the Garda to test at the side of the road.

    Instead of just allowing a garda to decide themselves and send a summons which only ends up wasting everyone's time.

    If your car is older than a 2008 there is one.. but you cant retrospectivly apply this to older cars so thats where the old Construction, Equipment and Use of Vehicles Act 1963 covers...

    The NCT then brings the whole lot under one umbrella.

    I was told to change my exhaust or put an additional silencer in it despite the fact he said "It would pass the NCT db test but in my opinion it is still too loud".
    Gave me 20 days to change it.

    Dont want all the grief of a summons so I'm just going to get rid of the decat. Not really bothered as it was a bit too loud at times really :P

    ...I understand you may not want the grief, but, tbh, if the car passed the NCT as-is, then, as above, a judge would have to give more credence to passing a physical, technical test, as mandated by the State, than the 'opinion' of the guard.........

    I heard on the radio the other day that the Guards in Cork are getting the sound level meters this month to check the noise levels in "Boy Racer" cars.
    They should have them for the bank holiday weekend

    Lovely......
