    Hi there,

    I am sorry if this is the wrong forum so mods feel free to move.

    If a particular ABC or CBS television production say from the 60s or the 70s

    were to be copied and sold on ebay for example,what are the legalities of

    same if the said productions were never released officially,i.e they are perhaps on youtube or elsewhere on the internet but not officialy released,

    am i right in saying that if no ownership rights are assumed or inferred by the seller,that no copyright infringement has been committed?

    i hope someone can help me.

    No, the copyright infringement has still happened. Just because they didn't put it on DVD themselves, doesn't mean anyone else can do it and sell it. The copyright is on the work itself, not the media it's released on.

    Yes that is how I understood the copyright laws myself Jor,but can you answer me this?

    Why is it that I see on a more and more regular basis, either deleted and unavailable legally,or totally unreleased material for sale on sites such as but not restricted to EBAY? I cannot go into specifics,butthere seems to be little doubt in my understanding that these items are illeagal,do ebay have any responsibility in this regard?

    Yes, and they will remove them if they see them, or they get reported. They're quite slow to do this. It's not just copyright either, eBay (and other auction sites) remove all kinds of illegal sales (counterfeit, knock-offs, etc).

    You will see certain things, like simpsons clips taken off youtube very quickly, some seem more worried than others. When usain bolt won the 100m the clips were been taken down every few minutes off youtube.

    I reported a copied book being sold on ebay several times, I contacted the author who did the same. The seller still had it up months later, along with lots of other copies.
